PHAZE2 LLC TERMS OF SALE

Please read these Terms of Sale carefully before purchasing any products or services from Phaze2 LLC. By placing an order, you agree to be legally bound by these terms.

1. Orders and Acceptance

All orders are subject to acceptance, and we reserve the right to refuse or cancel any order at our discretion. To process an order, Phaze2 LLC requires a signed quote or an approved purchase order from an authorized buyer.

2. Quotes, Pricing, and Payment

• Pricing is valid for the terms specified in the quote and fulfillment of quoted products is subject to availability.
• All prices are displayed in USD and exclude applicable taxes and shipping fees unless explicitly stated otherwise.
• We accept Credit Cards, Bank Transfers, and Physical Checks and the Customer represents they have the legal right to use the payment method provided. Applicable fees will be applied to Credit Card and ACH payments made through Phaze2 LLC platforms.

3. Shipping and Delivery

• Estimated delivery dates are non-binding. Phaze2 LLC is not responsible for delays caused by manufacturers, distributors, or third-party shipping couriers.
• Phaze2 LLC does not assume title and is not responsible for any lost, stolen, or damaged shipments. Risk of loss and title transfer to the buyer upon delivery to the carrier.
• Customers are responsible for assessing shipments and noting any damage or missing items on the delivery receipt before accepting delivery.
• If an entire shipment is visibly destroyed or unusable, the Customer should refuse the delivery.
• Any lost, stolen, damaged, or incomplete shipments must be reported to Phaze2 LLC within 30 days.

4. Returns, Refunds, and Cancellations

• Customers may return eligible products within 30 days of receipt for a refund and applicable restocking fees will be passed along to the Customer. Determination of products eligible for return is at the discretion of vendor, manufacturer, or distributor.
• Returned items must be unused and in their original packaging.

5. Warranties and Disclaimers

Except as expressly stated by us, all products and services are provided on an “AS IS” and “AS AVAILABLE” basis without any express or implied warranties, including implied warranties of merchantability or fitness for a particular purpose.

6. Limitation of Liability

To the maximum extent permitted by law, Phaze2 LLC shall not be liable for any indirect, incidental, or consequential damage resulting from your purchase. Our total financial liability to you shall not exceed the total amount you paid for the product or service in question.

7. Governing Law and Dispute Resolution

These terms are governed by the laws of Utah and USA. Any legal disputes arising from these terms will be resolved exclusively through binding arbitration in the courts of Farmington UT/Davis County USA.
